Why this matters: End Florida’s "Free Kill" Law

Florida's current "Free Kill" Law (FS § 768.21(8)) denies unmarried adults without minor children equal protection under the law, and deprives the survivors of these individuals of their right to access the courts in the case of medical negligence causing death. This means if an adult child (25+) or parent of an adult child (25+) dies due to medical malpractice, their survivors have no right to investigate or recover damages. The Florida Free Kill law is unconstitutional and fails to equally value the lives of all Floridians. 

In 2025, the bill to repeal Florida's Free Kill Law passed both chambers in the Florida Legislature, and then was vetoed by Governor DeSantis. In 2026, HB 6003, filed by Reps. Trabulsy and Lopez, passed the Florida House but was put on the backburner out of fear that DeSantis would simply veto it again. 

In 2027, there should be no excuses. Especially if we vote out the legislators that have stood in our way in the past. They have the bill, they just need to codify it into law. 

Repealing Florida's Free Kill law would expand the scope of damages in medical negligence wrongful death cases by allowing:

  •   Parents to recover damages for the death of a child aged 25 or older.
  •  Children (aged 25 or older) to recover damages for the death of a parent.

Florida deserves safe healthcare. All lives must be equally valued under the law.
