Florida's current "Free Kill" Law (FS § 768.21(8)) denies unmarried adults without minor children equal protection under the law, and deprives the survivors of these individuals of their right to access the courts in the case of medical negligence causing death. This means if an adult child (25+) or parent of an adult child (25+) dies due to medical malpractice, their survivors have no right to investigate or recover damages. The Florida Free Kill law is unconstitutional and fails to equally value the lives of all Floridians.
HB 6003, filed by Reps. Trabulsy and Lopez, seeks to repeal this unjust provision.
It expands the scope of damages in medical negligence wrongful death cases by allowing:
